Best Day Labs LLC ("we," "our," or "the app") operates the Days at the Office mobile application. This Privacy Policy explains how we collect, use, and safeguard your information when you use our mobile application.

Our Privacy Commitment: Your location data is processed entirely on your device and is never transmitted to our servers. We are committed to protecting your privacy and comply with applicable data protection laws.

1. Information We Collect

Location Data (Processed Locally Only)

The app uses your device's GPS to detect when you enter and exit designated locations you configure. This location data is:

• Processed entirely on your device using iOS geofencing capabilities
• Never transmitted to our servers
• Stored only in the app's local database on your device
• Used solely to calculate your attendance
• Permanently deleted when you uninstall the app

Usage Data (Anonymous and Aggregated)

We may collect anonymous, aggregated usage statistics through Apple's App Analytics to improve app performance and user experience. This data:

• Cannot be used to identify individual users
• Includes information such as app crashes, feature usage, and device types
• Is collected only if you have enabled "Share Analytics" in your iOS settings
• Does not include any location information

Account and Subscription Data

If you purchase a subscription, Apple processes all payment information. We receive only:

• Subscription status (active/expired)
• Subscription tier (monthly/annual)
• Anonymous transaction identifiers for verification

We do not receive or store your payment card information, billing address, or full name from Apple.

2. Legal Basis for Processing (GDPR)

For users in the European Economic Area (EEA), United Kingdom, or Switzerland, we process your data based on:

• Consent: You provide explicit consent when granting location permissions and agreeing to these terms
• Contract Performance: Processing is necessary to provide the attendance tracking service you requested
• Legitimate Interests: Anonymous analytics help us improve app stability and features while not overriding your privacy rights

3. How We Use Your Information

Your locally-stored location data is used solely to:

• Detect your presence at locations you configure
• Calculate your attendance hours and qualified days
• Generate attendance reports and analytics within the app
• Export attendance data at your request

We explicitly do NOT:

• Upload your location data to any server or cloud service
• Share your location data with third parties
• Track your location outside of configured geofences
• Sell, rent, or monetize your personal data in any way
• Use your data for advertising or marketing purposes
• Monitor your location when the app is uninstalled or location permissions are revoked

4. Data Storage and Retention

All attendance records and location data are stored locally on your device in an encrypted SQLite database. Data is retained:

• Until you manually delete it within the app
• Until you uninstall the app (all data is permanently removed)
• As long as you keep the app installed and wish to maintain your records

We do not maintain server-side backups of your personal data.

5. Data Sharing and Third-Party Services

The app uses the following third-party services:

• Apple StoreKit: For subscription management and in-app purchases. Subject to Apple's Privacy Policy
• iOS Location Services: For geofencing. Subject to Apple's Privacy Policy

We do not integrate analytics services, advertising networks, or other third-party trackers beyond Apple's native services.

6. Your Privacy Rights

For All Users:

• Access: View all your attendance data within the app at any time
• Export: Export your attendance data in CSV format
• Delete: Delete specific attendance records or all data within the app
• Revoke Permissions: Disable location tracking at any time in iOS Settings > Days at the Office > Location
• Complete Removal: Uninstall the app to permanently delete all associated data

For EEA/UK/Swiss Users (GDPR Rights):

In addition to the above, you have the right to:

• Rectification: Correct inaccurate data (you can edit records in the app)
• Restriction: Limit how we process your data
• Data Portability: Receive your data in a machine-readable format (CSV export)
• Withdraw Consent: Revoke consent for data processing at any time
• Lodge a Complaint: File a complaint with your local data protection authority

8. International Data Transfers

Since all location data is stored locally on your device and never transmitted to our servers, there are no international data transfers of your location information. Anonymous analytics data may be transmitted to Apple servers located in the United States and other countries where Apple operates, subject to Apple's Privacy Policy and data protection commitments.

9. Data Security

We implement appropriate technical and organizational measures to protect your data:

• Local data storage is protected by iOS's encryption and security features
• The app does not transmit location data over networks, eliminating interception risks
• Access to locally stored data requires device authentication (Face ID, Touch ID, or passcode)

10. Changes to This Privacy Policy

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal attendance tracking purposes, subject to these Terms. This license does not include the right to:

• Modify, copy, distribute, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, loan, or sublicense access to the App

3. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App to track anyone other than yourself without their explicit consent
• Attempt to reverse engineer, modify, hack, or tamper with the App's functionality
• Use the App in any way that could damage, disable, overburden, or impair its functionality
• Violate any applicable local, state, national, or international laws or regulations
• Use the App to violate the privacy rights of any third party
• Circumvent any access restrictions or usage limitations

4. Subscriptions and Payments

Subscription Plans

The App offers a free tier and paid subscription options (monthly and annual). Subscriptions provide access to premium features including support for multiple locations and advanced analytics.

Billing and Renewals

• All subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions
• Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date
• Your Apple account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription at any time through your App Store account settings: Settings > [Your Name] > Subscriptions

Refund Policy

All payments are processed by Apple. Refund requests are subject to Apple's refund policy. To request a refund:

• Sign in with your Apple ID
• Select "Request a refund" for the Days at the Office subscription

We cannot process refunds directly. All refund decisions are made by Apple in accordance with their policies.

Pricing Changes

We reserve the right to modify subscription prices. Price changes will apply to new subscriptions and renewals after 30 days' notice. Existing subscribers will be notified via the App before any price change takes effect.

Free Trial

We may offer free trial periods for premium features. Free trials automatically convert to paid subscriptions unless canceled before the trial period ends. You can cancel at any time during the trial without charge.

5. Accuracy Disclaimer and Limitation of Use

Critical Disclaimer: GPS-based location tracking has inherent limitations and may not always be 100% accurate. Factors affecting accuracy include: device GPS capability, signal interference, indoor locations, tall buildings, weather conditions, and iOS background processing limitations.

The App is designed as a personal convenience tool. We recommend:

• Using the App as a personal reference and convenience tool
• Cross-checking attendance records periodically for accuracy
• Maintaining independent records for any critical needs

6. Intellectual Property Rights

The App, including all content, features, functionality, design, software, text, graphics, logos, and trademarks, is owned by Best Day Labs LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted only the limited license described in Section 2. All other rights are expressly reserved by us.

7. Disclaimers and Limitation of Liability

No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT:

• The App will function without interruption or errors
• Defects will be corrected
• The App is free of viruses or harmful components
• Location tracking will be 100% accurate at all times
• The App will meet your specific requirements

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BEST DAY LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, revenue, data, or goodwill
• Service interruption or data loss
• Reliance on inaccurate location data
• Any other losses resulting from your use or inability to use the App

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE (12) MONTHS, OR $100, WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless Best Day Labs LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of third parties
• Your violation of applicable laws

9. Modifications to the App and Terms

We reserve the right to:

• Modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice
• Modify these Terms at any time by posting the updated Terms in the App and on our website

Continued use of the App after changes to these Terms constitutes acceptance of the modified Terms. We will provide notice of material changes through the App.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of applicable laws
• Fraudulent or illegal use of the App
• Misuse that harms us or third parties

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

11. Dispute Resolution and Arbitration

Informal Resolution

Before filing a claim, you agree to contact us at bestdaylabs@gmail.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If informal resolution fails, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except:

• You may assert claims in small claims court if your claims qualify
• You or we may seek equitable relief in court for intellectual property infringement

Class Action Waiver

YOU AND BEST DAY LABS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to bestdaylabs@gmail.com within 30 days of first accepting these Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms (if not subject to arbitration) shall be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to personal jurisdiction and venue in such courts.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Best Day Labs LLC regarding the App and supersede all prior or contemporaneous understandings and agreements, whether written or oral.
